The current economic environment has resulted in many businesses having to restructure their financing arrangements or waive debt obligations. While the arrangements entered into between debtors and creditors may be commercially prudent, the parties involved seldom consider the tax consequences that may arise from such dealings. This session aims to inform practitioners about the tax consequences of forgiving or restructuring debt. It covers:

  • What is a debt forgiveness?
  • Analysis of the commercial debt forgiveness provisions and the debt forgiveness provisions in Division 7A (e.g. Div 7A consequences of guarantee or debt parking arrangements)
  • CGT implications of forgiving or restructuring debts
  • Analysis of the bad debt provisions
  • What are the tax consequences of writing-off an unpaid present entitlement?
  • Practical case studies (e.g. tax issues for forgiving debit and credit loans)

David Marschke, Principal, DBM Horizons, Queensland

David is a specialist tax and legal adviser who acts for listed and private corporate groups, and their owners, in all areas of tax and related law including GST and state taxes. David’s tax expertise spans a wide range of industries and sectors including property development, investment funds, professional services, technology and intellectual property. David has significant experience dealing with capital raising and capital management issues including restructuring for IPOs, rights issues, financial instruments and hybrid securities, share buybacks, and capital reductions. David has been involved in a wide range of M&A transactions acting for listed and unlisted groups as well as private equity transactions.

He is a specialist adviser on trust law and taxation of trusts including MITs.

In addition, David has significant experience assisting taxpayers and their advisers in dispute matters including tax reviews, audits and complex tax negotiations, and settlements with the ATO and the State revenue offices.

David founded dbm horizons as a boutique legal, tax and consulting firm.  Prior to founding dbm horizons David was a tax partner at national law firm.

David is a Legal Practitioner, Registered Tax Agent, Chartered Tax Adviser and is a member of Chartered Accountants Australia and New Zealand.
