Recorded Webinar: Contract Termination in a Volatile Property Market (VIC)

Date: Wednesday 9th December 2020
Duration: 1 Hour

 ABOUT THE WEBINAR
It’s a fact of life that not all property transactions will have a happy ending. In this session we examine some examples and issues surrounding contract cancellation and rescission, completion delays and defaults and what steps can be taken to manage the fallout and minimise the risks, including:

  • When does the standard Contract of Sale allow termination? What further terms should a vendor or purchaser seek to include?
  • “Subject to” conditions – what constitutes satisfactory evidence for contract cancellation?
  • What is the difference between rescission and repudiation? What breaches result in either situation?
  • A discussion of contract termination for:
    • Misrepresentation
    • Misleading and deceptive conduct
    • Material changes in off the plan contracts
  • Delayed settlements: practical and legal issues for your clients
  • Disappearing builders: contract consequences and deposit issues
  • Sunset clauses in developers’ contracts
  • What remedies are available to an aggrieved party?
  • What happens next? Advising your client on next steps.
