The spectre of a Family Court dispute can loom large in the estate planning process, depending on the testator, their family and the personal relationships in that web. This session pulls together a range of relevant issues that can arise when trying to structure an estate in the most tax effective way, including:

  • When can the Family Court look through or override existing arrangements or trustee decisions?

  • Protecting the assets in the event of divorce:

  • Managing a family settlement where assets are sitting either in historical family trusts or in the name of one spouse

Craig Henderson, Partner & Practice Group Leader, Lander & Rogers, Melbourne
