This session will set you straight on the definitions of the different employment types, and have you thinking about the risks associated with miscategorising the employment relationship. Matters covered include:

  • Common law and workplace instrument definitions of employment types:

    • fixed term

    • maximum term

  • Operational considerations - what is the right type for your business’s needs?

  • Legal risks of miscategorising employees, particularly casuals who are not really casuals

  • When casual conversion is required by Awards

  • Legal risks associated with term contracts, with reference to case law including Saeid Khayam v Navitas English Pty Ltd [2017] FWCFB 5162

Nick Ruskin, Partner, K&L Gates, Melbourne

Mr Ruskin practises in labour relations and employment law. He represents corporations in a number of industries including energy, retail, services and healthcare, and public sector clients in the health, higher education, government and community sectors.

He has extensive experience in labour disputes, employment claims, anti-discrimination issues, legislative compliance, advocacy before tribunals and providing forthright, practical advice to clients.

He is active in human resources circles through his role as convenor of the employee relations committee of the Australian Human Resources Institute (Victoria) and is a regular speaker and commentator at professional conferences on labour relations law.

He is a member of the Legal Profession Reference Group, an advisory body to the President of the Fair Work Commission, Justice IJK Ross.
