It’s been just over seven months since the introduction of the GST withholding rules on new residential property on 1 July 2018. Now that the dust has settled on the initial implementation, what complexities and challenges are we seeing? This session covers tips and traps based on experience of how the provisions have operated in practice, including:

  • In complex situations (e.g. multiple vendors, multiple purchasers or nominee purchasers):

    • who is meant to notify?

    • who is meant to withhold?

  • Managing the GST compliance:

    • what are the key questions that you need to be asking your clients?

    • 5-year rule - has the property been used exclusively for rent?

    • calculating the amount to withhold - what do you need from your client?

  • How to deal with mixed premises blocks - a case study of a farm with old premises and new premises

  • Tips on managing logistical and technical issues relating to the ATO’s reporting system.

  • How are property developers managing the cashflow issues?

Simone Bridges, Partner, Baker & McKenzie, Sydney

Simone is part of the Sydney office of Baker McKenzie and holds a leadership role on the Firm's Global Indirect Tax Steering Committee, representing the Asia-Pacific region.

Simone has been listed as a Women Leader in Tax three years in a row by the International Tax Review (2016 and 2018) and has also been ranked by Legal 500 as a New Generation Lawyer for 2018. Simone is a regular panelist and speaker at tax events such as the Tax Executive Institute's International Tax workshops and the annual International VAT/GST Conference hosted in Europe.

Simone advises multinationals and large domestic clients on Australian tax issues and primarily specialises in indirect taxes, cross border tax issues, managing tax controversy for multinationals and customs/trade. Her practice includes planning and advisory work, tax disputes as well as negotiations with revenue officials on a range of matters.
