As COVID-19 continues to sweep the globe, its impact is being felt in every sector, particularly real property. This session examines the emergency measures that have been implemented as a result of the pandemic and how leases, and the sale and purchases of property, have been affected. It covers:

  • Unpacking COVID-19 Legislation Amendment (Emergency Measures) Act 2020 No 1 and its impact on property transactions:

    • Changes to the Retail Leases Act

    • Changes to the Residential Tenancies Act

    • Changes to the Electronic Transactions Act

  • Sale and purchases of property:

    • Practical implications of the restrictions on marketing a property

    • Is COVID-19 status a ‘material fact’ under the principles of Hinton & Ors v Commissioner for Fair Trading, Office of Fair Trading?

    • Verification of identity and the VOI standard. 

      What if the premises are affected? Does the vendor have a duty to clean the premises prior to completion? If so, to what standard and what evidence should be provided?

    • What if a party to the contract is self-isolating or quarantined at a critical time? What about other residents of the property?

    • Sales of properties currently tenanted but to be vacant on settlement: are there new restrictions on removing the tenant?

    • What if the circumstances of a purchaser change due to the economic downturn? Might a “subject to finance” clause be prudent in these extraordinary times?

    • Drafting appropriate special conditions - what event/s trigger the clause? What remedies are appropriate if the clause is activated - delayed settlement vs rescission vs termination?

Tony Cahill was admitted as a solicitor in 1981. In July 2002 he commenced a ‘sabbatical’ from private legal practice to concentrate on legal education and writing.

He was a co-author with Russell Cocks and Paul Gibney of the first New South Wales edition of 1001 Conveyancing Answers, and is currently a co-author of Conveyancing Service New South Wales and Annotated Conveyancing and Real Property Legislation New South Wales, both published by LexisNexis.
