As non-real property taxes are eliminated, the proportion of state revenue derived from real property increases. With this comes an increase in disputes about the value of real property in the context of transfer duty, landholder duty and land tax. This session explores the various valuation issues that arise in duty and land tax from the perspective of a tax expert and includes a consideration of:

  • Commissioner of State Revenue v Placer Dome Inc [2018] HCA 59:

    • does Placer Dome change the way that valuers calculate land value for duty and land tax purposes?

    • what are the technical implications from Placer Dome for transfer and landholder duty?

  • Should a different value be placed on majority versus minority shareholders in a company?

  • Should a forced sale constitute market value? Parklea (Estates) Pty Ltd v Commissioner of State Revenue (Review and Regulation) [2018] VCAT 143

  • Are valuation principles for land tax the same as those for transfer duty and landholder duty?
