As announced in the 2017/18 Budget, legislation has been passed to require purchasers of new residential premises or subdivisions of potential residential land to withhold GST from the purchase price and remit to the ATO. This session addresses the complexities inherent in these provisions and explores the following:

  • What types of transactions are caught?

  • Grandfathering provisions for contracts entered into before 1 July 2018

  • Application of the withholding provisions to:

    • Tripartite situations or where there is a nominee purchaser – who receives the notice and who remits the GST?

    • Related party transactions

    • Where the legal owner is different from the supplier (for example trusts and partnerships)

  • Rapid refund system

  • How will mistakes be managed?

  • ATO guidance

  • Reviewing standard form contracts and other practical guidance

Simone Bridges, Partner, Baker & McKenzie, Sydney

Simone is part of the Sydney office of Baker McKenzie and holds a leadership role on the Firm's Global Indirect Tax Steering Committee, representing the Asia-Pacific region.

Simone has been listed as a Women Leader in Tax three years in a row by the International Tax Review (2016 and 2018) and has also been ranked by Legal 500 as a New Generation Lawyer for 2018. Simone is a regular panelist and speaker at tax events such as the Tax Executive Institute's International Tax workshops and the annual International VAT/GST Conference hosted in Europe.

Simone advises multinationals and large domestic clients on Australian tax issues and primarily specialises in indirect taxes, cross border tax issues, managing tax controversy for multinationals and customs/trade. Her practice includes planning and advisory work, tax disputes as well as negotiations with revenue officials on a range of matters.
