Sentencing submission is an extremely important part of criminal practice. Understanding the practicalities of the submission process is the subject of this session, including:

  • Preparing a written outline of submissions

  • Dealing with aggravating features – don’t hide problems away

  • Ensuring the prosecutor has nothing to say – some practical tips

  • Care required in what you are seeking – not too much nor too little

  • What to put in your submission – the importance of sequential order

  • Some key areas to focus on:

    • record and special circumstances

    • subjective features

    • assistance to authorities

    • nature of imprisonment

  • Presenting the range of sentences for the offence

  • Should defendant give evidence?

  • Case study – examples of submissions that work in client’s favor

Angela Cooney, Managing Associate, Armstrong Legal, Sydney

Angela is able to assist clients with all criminal offences such as assaults, drug charges, traffic matters, theft, break and enters, firearms, sexual offences and apprehended violence orders.

Angela is an experienced Court advocate having appeared in the Local and District Court, the Court of Criminal Appeal as well as in Federal jurisdictions in a multitude of matters, including complex strictly indictable trials.

After graduating with First Class Honours and prior to joining Armstrong Legal, Angela worked as a criminal lawyer on the Far South Coast of NSW and was a delegated Legal Aid NSW lawyer where she developed impressive skills working in high pressure roles supporting disadvantaged clients.

With years of experience in criminal and traffic law, Angela’s knowledge is of benefit to clients as she understands the often interrelated issues that arise and is able to guide clients through emotional and difficult times with sensitivity.

Angela is passionate about providing clients with high quality and easy to understand legal advice and her experience allows her to provide clients with a first class service.
