The spectre of Part IVA hangs over every arrangement or transaction undertaken by clients but many practitioners still have a limited understanding of the operation of the general anti-avoidance rules. This session seeks to broaden the understanding of practitioners in this often neglected area of law. The following issues are discussed:

  • What is legitimate tax planning?
  • Practical analysis of Part IVA (e.g. What is the dominant purpose test?)
  • Comparison with GST anti-avoidance rules and section 177EA (franking credit trading arrangements)
  • Interaction of Part IVA and other provisions of the income tax law (e.g. if a client engineers their affairs to specifically access a particular concession is that tax avoidance?)
  • Examination of the COVID-19 stimulus package integrity rules
  • Risks for the adviser (e.g. promoter penalty rules, TASA obligations, breaches of code of conduct)

Mark Gioskos, Senior Associate, Thomson Geer, Melbourne

Mark specialises in giving advice in complex tax litigation and tax audit matters. He has extensive experience in negotiating and settling tax-related disputes, with an emphasis on achieving efficient and commercial outcomes for his clients. Mark also regularly advises clients on various compliance issues under both Federal and State based revenue laws, as well as corporate and governance issues, succession planning and estate administration, and other regulatory matters. Mark is a Fellow member of The Tax Institute, and lectures on various tax law topics for The Tax Institute's Chartered Tax Adviser Program.  He is also been a member of The Tax Institute's Professional Development Committee in Victoria.  Mark has authored a number of articles published in professional journals, and is a regular presenter at seminars and discussion groups.


This webinar is suitable for accountants advising in taxation matters - Australia wide. This webinar is for practitioners with some knowledge in this area and looking to improve their knowledge.
