It’s common for parents to intend that their assets be split equally between all their children. However, implementing this in practice has many challenges, including the differential tax profile of different beneficiaries and different assets. This session explores the challenges and how to manage these including:

  • Is there a way to manage lumpy assets other than by liquidating?

  • How do you manage the different tax profiles of the beneficiaries?

  • Working with the tax profiles of different assets:

  • Drafting a tax equalisation clause: when is it triggered, what adjustments to other assets are made

  • Options for valuing the asset base for equalisation calculation: based on NPV, pre- or post-tax?

  • Does the executor have discretion to determine the process of equalisation or is the will specific in its terms?

Patrick Huang is a Senior Associate in Coleman Greig’s Taxation Advice team, having joined the firm as part of its 2019 integration with Argyle Lawyers.

With over 6 years’ experience as a taxation and commercial lawyer, Patrick has extensive experience in general commercial law, corporate governance, asset protection, tax and business structuring, tax controversy business succession planning and employment taxes matters. From advising clients on tax and business structures, employee share schemes, buy-sell agreements, contract review, capital raisings and M&A transactions, no day is the same.

Patrick has experience working for a wide array of clients which have included charities, professional services firms (including accountants and financial planners) high-net worth individuals, family groups and SMEs.

Some examples of his work have included helping a small business owner with the settlement of a multi-million dollar tax dispute, acting on the sale of a $10m financial planning and mortgage brokerage client book, assisting financial planners to dealing with adverse action claims and acting on a complicated $5m capital raising involving an APRA-regulated life insurance company.
