Where the beneficiaries of an estate are spread across different jurisdictions (and especially where the assets are also multi-jurisdictional), one of the questions that can arise is the extent to which the testator wishes to equalise the tax treatment amongst beneficiaries of his or her estate. This session steps through the logistics of seeking equal post-tax bequests, including:

  • Where overseas and Australian resident beneficiaries receive equal shares of the estate, will the Australian beneficiaries be effectively liable for the tax liability of the overseas beneficiaries?
  • Where overseas residents have a higher rate of tax payable in their resident jurisdiction on distribution of the estate, should the estate be framed to distribute more to them pre-tax?
  • Should the allocation of assets to beneficiaries change when assets are located in multiple jurisdictions?
  • Should a tax equalisation clause be included in the will by way of a formula calculating notional tax?
  • Managing top up tax – how do you equalise the equalisation payment?

Neil is a Principal in Sladen Legal’s tax group. Neil practises in all areas of direct and indirect tax with a particular focus on the taxation of trusts, deceased estates, income and capital gains tax, and Division 7A.

Neil has also advised extensively on cross border taxation issues and the GST implications of transactions and dealings in the development of property. Using his technical tax knowledge, Neil works with clients to obtain commercial and practical outcomes. He has particular experience in dealing with the Australian Taxation Office on complex tax issues in a dispute resolution context.

Neil is a keen and active member of the tax community. As well as presenting on tax topics at various sessions, he has authored and co-authored several published articles, papers, and bulletins. Neil is a member of the Tax Committee of the Law Council of Australia, an Accredited Specialist in Taxation Law and Chair of the Tax & Revenue Law Committee with the Law Institute of Victoria and a Chartered Tax Advisor and member of the SME, Dispute Resolution, and GST Technical Committees with The Tax Institute.
