With the ATO’s crackdown on trust splitting and trust cloning in recent years, taxpayers and advisers need to look to other options for tax effective separation of trust assets. This session explores the options for getting a similar legal or economic position as trust splitting, including:

  • the availability of CGT concessions and rollovers to transfer assets

  • tailoring company constitutions

  • entering into deeds of family arrangement

  • making interim capital distributions and loan back arrangements

  • amending trust deeds to allocate particular assets to adult children beneficiaries after the death of the parents

  • whether these options sit within the ATO views on trust resettlement?

Murray Shume, Special Counsel, Cooper Grace Ward Lawyers, Brisbane    

Murray is a Special Counsel in Cooper Grace Ward’s tax and tax disputes team.

Murray advises on a broad range of income tax and indirect tax issues. His areas of expertise include the taxation of trusts, CGT small business concessions, land subdivisions, international tax, residency issues, employee share schemes, non-commercial losses, GST, duty and payroll tax.

Murray also acts for taxpayers involved in disputes with the ATO. He acts for taxpayers in audits and objections. He also acts for taxpayers in appeals before the Tribunals and Courts. His recent experience includes acting for the taxpayer in Harding v Federal Commissioner of Taxation [2018] FCA 837 and Harding v Federal Commissioner of Taxation [2019] FCAFC 29.

Before joining Cooper Grace Ward, Murray worked at the ATO for four years. This experience provides Murray with a unique perspective when dealing with ATO.
