Understanding what interest in land is sufficient to justify placing a caveat is tricky. Its use as a negotiating tactic has to be carefully considered, especially if the interest is not enough to justify its use. This session includes:

  • What is a caveatable interest? – how is it different from a regular interest in property?
  • Lodging caveats and what happens after it is lodged

Tim Graham, Partner, HWL Ebsworth Lawyers, Melbourne

Admitted to practice in 1998 Tim Graham practices exclusively in the areas of Strata and Subdivision Law, Owners Corporations and dispute resolution and associated areas including building & constructions and planning law.

Tim has been awarded Fellowship of the Australian College of Community Association Lawyers for his expertise and regard by his peers as a specialist in Owners Corporations and Subdivision Law. Tim is the Victorian State Co-ordinator of the College.

Whilst Tim represents Owners Corporations of all sizes his clients include many of Melbourne’s largest and most iconic buildings, broadacre developments and gated communities. He also acts for retirement villages and aged care facilities, resorts, golf courses, shopping centres and industrial parks.

Tim has extensive experience e in domestic and commercial construction law matters, providing contractual advice and appearing in building defects claims, insurance reviews and repair & maintenance cases in the VCAT and the Courts.

He is a regular presenter on Owners Coporations and Subdivision Law topics, conducting over one hundred seminars for a range of professional associations, management bodies and financial institutions.
