There are times when a practitioner receives an urgent request from a client, such as to lodge a caveat. Acting before taking a number of important steps can get practitioners into serious trouble. This session will explore how to effectively and successfully respond to the receipt of urgent instructions, including:

  • How the move to electronic dealings has resulted in greater pressure on practitioners
  • Shifting the risk – practitioner assessments and verifying statements
  • Does your client have a valid claim? Case study: Guirgis v JEA Developments Pty Ltd  [2019] NSWSC 164
  • The role of the “guardian at the gate” – what a practitioner needs to know before lodging a caveat and making representations
  • Consequences for practitioners, including costs orders and disciplinary action

Mark Swan, Special Counsel, Mills Oakley, Sydney

Mark is an accredited specialist in property law with over 30 years’ experience.  His practice interests are focussed on private and government transactional, leasing and development work, particularly strata titles.

Since 2006, Mark has served as a member of the Property Law Committee of the Law Society of New South Wales.  As a member of the NECS sub-committee, and as one of the NSW representatives on the Law Council of Australia’s NECS Working Group, he has been closely involved in the NSW legal profession’s stakeholder contribution to the implementation and ongoing development of the National Electronic Conveyancing System.
