A well-drafted employment contract can provide a strong foundation for a positive employment relationship and helps minimise the risk of disputes down the track. However, choosing the right type of employment contract can be difficult. This session examines the key issues that HR professionals need to consider when documenting employment arrangements and how you can best manage these risks. It covers:

  • Do you always need a written employment contract?

  • Determining the right employment type: permanent, casual, fixed term or maximum term – and why it matters

  • Compliance with the NES and applicable modern award or enterprise agreement

  • Key inclusions to consider: salary, superannuation, annual leave, probation periods, long service leave, confidentiality, ownership of intellectual property that the employee creates, termination of employment and obligations on termination

  • Is the employment contract consistent with your company’s policies and procedures?

Philippa Noakes, Senior Associate, Seyfarth Shaw, Sydney

Philippa Noakes is a senior associate in the International Employment Law group of Seyfarth Shaw Australia.  

Philippa’s experience covers the spectrum of employee-employer relations including corporate advisory work, contracts of employment, terminations and redundancy implementations, enterprise bargaining and strategic industrial advice. In addition to this, Philippa has also gained specialist exposure in unlawful discrimination and breach of contract claims. 

Prior to joining Seyfarth Shaw, Philippa worked at a large international law firm, where she was seconded to Singapore to work in the corporate (mergers and acquisitions) team. This experience complemented her commercial employment experience and transactional knowledge.
