 The Age of Entitlement: Eligibility for Family Provision Claims

Every Australia state and territory has statutory provisions giving the courts a discretion to make further provision for an eligible applicant out of a deceased estate.  As is inevitable with rules set at the state and territory level the family provision eligibility requirements differ from jurisdiction to jurisdiction.  In this program, barrister John Armfield, from Second Floor Wentworth Chambers in Sydney, reviews the various eligibility requirements, and through the case law, the general principles that can be identified as applying to those requirements.
