 Section 90K(1)(d) and the Enforcement of Financial Agreements

Family Law Act 1975, s 90K, sets out a number of grounds on which a financial agreement can be set aside.  The grounds include section 90K(1)(d), which permits an agreement to be set aside because of a “material change of circumstances “.  In this program, Liz Weldon, from Mitchell Family Law in Melbourne, provides a detailed analysis of the provision; reviews recent cases where the Courts have or have not agreed that an agreement should be set side under s 90K(1)(d); and the drafting issues for lawyers.
