 Secret Recordings in Parenting Matters: When Can You Press Play?

The widespread availability, and ease of use, of recording devices has, in recent years, resulted in an increase in parents in family law proceedings making secret recordings of conversations and interactions with the other parent (often involving their children) with the objective of using the recordings to support the parent’s case.   In this program, Phillip Ridgway, from Pearson Emerson in Sydney, looks at the desirability of such recordings; when and why they may be illegal; and the approach of the family courts to the admissibility of such recordings in family law proceedings.
