 Adjusting for Future Needs in Property Settlements: Time to Take Out the Crystal Ball?

Assessing the “future needs” of each of party is the third step in the “four step” process applied by the Family Court in determining property settlement applications.  In this program, Paul Fildes, from Taussig Cherie Fildes Lawyers in Melbourne, looks at the Courts’ approach to assessing needs in the context of the list of factors set out in Family Law Act 1975, s 75(2) and s 90SF(3), as well as the current relevance of family violence in the property settlement assessments, and ALRC proposed amendments to the legislation.
