Adverse action proceedings on the basis of discrimination are increasing. Employers need to be aware of the risks in terminating employment where there is a causal link to race, sex, age, physical or mental disability or marital status. This presentation will cover what to do when faced with an adverse action claim based on allegations of discrimination.  It includes:

  • General protections and discriminatory grounds – a look at section 351 of the Fair Work Act
  • Causal link and reverse onus – challenges for employers defending adverse action claims in discrimination cases
  • Discrimination, victimisation and adverse action –  Are the interpretations under the adverse action provisions consistent with the understanding of anti-discrimination law?
