A testamentary discretionary trust established can be a useful way for clients to maintain control, even after death. However, special care is needed in how they are drafted. This session focuses on key drafting issues with testamentary trusts and includes:

  • Construction of testamentary trust – key drafting issues and provisions:
    • vesting day / term
    • income clause
    • use of default beneficiaries
    • determining class of beneficiaries
    • powers and veto rights of appointors / guardians
  • Simple vs complex – short form vs long form
  • Optional testamentary trusts
  • Control of testamentary trusts
